These Terms and Conditions (“Terms”) govern your use of jps-tree.com (the “Site”), operated by JPS Tree Services (“JPS Tree Services,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Use of the website

The Site provides information about our tree removal, storm cleanup, emergency tree service, and stump grinding services in Wethersfield, Connecticut and nearby communities. You may use the Site for lawful, personal purposes only.

You agree not to:

• Submit false, misleading, or someone else’s information
• Send spam, malicious code, or automated requests to the Site
• Copy, scrape, or reuse Site content for commercial purposes without our written permission
• Interfere with the Site’s operation or security

We may change, suspend, or discontinue any part of the Site at any time without notice.

Estimates and service requests

Submitting a form, calling, or texting us is a request for information or an estimate, not a contract for service. Estimates are free.

• Estimates are not binding until accepted in writing. A job is confirmed only when you and JPS Tree Services agree to a written estimate, work order, or contract. That agreement governs the work, and its terms control if they conflict with these Terms.
• Pricing on the Site is general. Any prices, ranges, or promotions shown online are estimates only. Final pricing depends on an on-site or photo assessment of tree size, condition, access, and hazards.
• Conditions may change the price. Hidden hazards, rot, buried objects, or conditions different from what was described may require a revised estimate before work continues.
• Promotions may have limits and expiration dates, cannot be combined unless stated, and may be changed or ended at any time.
• Scheduling and emergencies. We aim to meet requested dates, but weather, storms, safety concerns, and utility coordination can cause delays. We are open 24/7, including for emergencies, subject to crew availability. For downed lines or immediate danger, call 911 and your utility company first.
• Property access and permits. You are responsible for confirming you own the property or have the owner’s permission, identifying property lines, and telling us about underground utilities, irrigation, or septic systems. Unless agreed otherwise in writing, you are responsible for any permits or HOA approvals.

Text messaging terms

By providing your mobile number and opting in, you agree to receive texts from JPS Tree Services about estimates, appointments, job updates, and occasional offers. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Website content and intellectual property

The Site’s text, photos, logos, graphics, and design, including the JPS name and logo belong to JPS Tree Services or its licensors. You may not copy, modify, or distribute them without our written permission.

Photos, reviews, and submissions

If you send us photos, reviews, or testimonials, you confirm you have the right to share them. You give us permission to use them, without payment, to evaluate your job and, with your consent where required, to display them on the Site or in our marketing. We may remove any content at our discretion. Before-and-after photos of completed work may be used in our marketing unless you ask us not to.

Information only; no professional advice

Tree care articles and tips on the Site are general information, not a professional assessment of your trees. Tree health and risk can only be judged by an in-person inspection. Never attempt hazardous tree work yourself.

Third-party links and services

The Site may link to or embed third-party services, such as Google Maps, Google reviews, or social media. We do not control and are not responsible for their content, terms, or privacy practices.

Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the Site, including that it will be accurate, uninterrupted, or error-free. Warranties for actual work, if any, are only those stated in your written estimate or contract.

Limitation of liability

To the fullest extent permitted by law, JPS Tree Services and its owners, employees, and contractors are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site is limited to $100. This section does not limit liability for work performed, which is governed by your service agreement and applicable law.

Indemnification

You agree to indemnify and hold harmless JPS Tree Services from claims arising from your misuse of the Site, your violation of these Terms, or content you submit.

Governing law and disputes

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute about the Site will be resolved in the state or federal courts located in Hartford County, Connecticut, and you consent to their jurisdiction. Before filing a claim, you agree to contact us first so we can try to resolve the issue informally.

Changes to these Terms

We may update these Terms at any time by posting a new version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept them.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement about your use of the Site.
